1. Introduction

Posma AI, Inc. (“Posma AI,” “Company,” “we,” “us,” or “our”) provides an AI-powered personal brand management platform designed primarily for established U.S.-based real estate professionals.

The Posma AI platform helps users develop personal brand positioning and strategy and execute that strategy through AI-assisted content, listing narratives, market communications, engagement responses, and related brand activities.

This Privacy Policy explains how we collect, use, disclose, retain, and otherwise process personal information when you access or use our websites, applications, platform, communications, and related services (collectively, the “Services”).

Posma AI, Inc. is a Delaware corporation operating primarily in the United States.

By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.

  • visitors to our websites;
  • individuals who communicate with us;
  • individuals whose information users choose to provide through the Services, where applicable; and
  • users of integrations or features that exchange information with third-party services.

This Privacy Policy does not govern the independent privacy practices of third-party websites, platforms, applications, or services. When you interact with a third-party service, its own privacy policy and terms may apply to its processing of your information.

Payment processors process information according to their own terms, privacy policies, and applicable agreements with us.

3.4 AI Processing

Certain Posma AI features use artificial intelligence services provided by Posma AI and/or third-party AI service providers.

When you use these features, information necessary to generate the requested output may be transmitted to and processed by those providers.

Such information may include:

  • prompts and instructions;
  • relevant Brand Profile information;
  • positioning and strategy context;
  • property or listing information;
  • content inputs;
  • previous or related content where necessary to provide contextual continuity;
  • generated content; and
  • other information reasonably necessary to provide the requested AI-powered feature.

Third-party AI providers process information subject to our applicable arrangements with them and their relevant terms, privacy commitments, and data-processing practices.

Where we use OpenAI's business/API services, OpenAI states that inputs and outputs submitted through its API are not used to train its models by default unless the customer affirmatively opts into applicable data-sharing mechanisms. Provider practices and Posma AI's providers may change over time.

The information involved depends on the integration, permissions you authorize, and features you use.

Third-party platforms process information according to their own privacy policies, terms, and practices. Posma AI does not control the independent privacy practices of those third parties.

5.3 Legal and Safety Disclosures

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with applicable law or legal process;

5.4 Business Transactions

If Posma AI is involved in or considering a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, personal information may be disclosed to relevant parties as part of evaluating, negotiating, or completing that transaction, subject to applicable law and appropriate protections.

6. AI-Specific Disclosures

6.1 Nature of AI-Generated Outputs

Posma AI uses artificial intelligence to assist with positioning, strategy, content, communications, and related functionality.

AI-generated outputs are generated algorithmically and may occasionally be inaccurate, incomplete, inappropriate, outdated, or otherwise unsuitable for a particular purpose.

Users should review generated outputs before publishing, distributing, or relying on them.

6.2 User-Provided Information

Posma AI may rely on information supplied by users when generating outputs. We generally do not independently verify all user-provided information, including property facts, market information, competitor information, professional claims, or other factual inputs.

Users should not submit information they do not have the right or authority to provide or process through the Services.

6.3 Real Estate Marketing and Compliance

Posma AI may include features, prompts, rules, or safeguards designed to support responsible content creation and reduce common real estate marketing risks.

However, such features do not constitute legal advice and do not guarantee compliance with Fair Housing requirements, MLS rules, advertising laws, brokerage policies, licensing requirements, disclosure obligations, intellectual-property requirements, platform rules, or other applicable requirements.

Users remain responsible for reviewing and approving content before publication and for ensuring that their use of the Services and resulting content complies with applicable requirements.

7. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy.

Retention periods may vary depending on:

  • the type of information;
  • how and why it is used;
  • whether an account remains active;
  • operational and security requirements;
  • contractual requirements;
  • legal and regulatory obligations;
  • dispute-resolution needs; and
  • applicable limitation periods.

We may retain certain information after an account is closed where reasonably necessary to comply with legal obligations, maintain business or transaction records, prevent fraud or abuse, enforce agreements, resolve disputes, or protect legal rights.

Information processed by third-party service providers may be retained according to the applicable provider's terms, configuration, and data-retention practices.

Where information has been aggregated or de-identified so that it can no longer reasonably be associated with an identifiable individual, we may retain and use that information as permitted by applicable law.

8. Data Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure, taking into account the nature of the information and the Services.

We also rely on third-party infrastructure and service providers that maintain their own security measures.

However, no method of electronic transmission, storage, or processing is completely secure. Accordingly, we cannot guarantee the absolute security of information processed through the Services.

Users are responsible for maintaining the confidentiality of their account credentials and should notify us if they believe their account or information has been compromised.

9. U.S. Privacy Rights

Depending on your state of residence, Posma AI's activities, and the applicability of relevant law, you may have certain rights regarding your personal information.

These rights may include the right to:

  • request access to or confirmation regarding personal information we process about you;
  • obtain a copy of certain personal information;
  • request correction of inaccurate personal information;
  • request deletion of certain personal information;
  • opt out of certain forms of processing where applicable;
  • withdraw consent where processing is based on consent and applicable law provides that right; and
  • appeal certain decisions regarding privacy requests where applicable.

You may also have a right not to receive unlawful discriminatory treatment for exercising applicable privacy rights.

These rights are not absolute and may be subject to eligibility requirements, verification requirements, exceptions, and limitations under applicable law.

For example, California law provides qualifying consumers with rights concerning access/knowledge, deletion, correction, sale or sharing, certain sensitive-personal-information practices, and non-discrimination when the law applies to a particular business.

Delaware similarly requires covered businesses to provide residents with information about collected personal data, purposes, disclosures, sales where applicable, and available privacy rights.

10. How to Exercise Your Privacy Rights

To submit an applicable privacy request, contact:

Email: support@posma.ai

Please describe the nature of your request and provide sufficient information for us to identify the relevant account or information.

We may request additional information where reasonably necessary to verify your identity, authority, or request. Information provided for verification will be used for that purpose and related security or compliance purposes.

Where permitted by applicable law, an authorized agent may submit a request on your behalf. We may require evidence of the agent's authority and/or verification directly from you.

We will respond to valid requests in accordance with applicable legal requirements.

If applicable law gives you a right to appeal our decision regarding a privacy request, you may submit an appeal by contacting support@posma.ai and identifying the request and decision you wish to appeal.

11. Cookies and Similar Technologies

We and our service providers may use cookies, local storage, pixels, tags, and similar technologies in connection with our websites and Services.

Depending on the technologies and features in use, these technologies may help us:

  • provide essential website or application functionality;
  • authenticate users;
  • maintain sessions;
  • remember settings or preferences;
  • protect the Services;
  • understand how the Services are used;
  • diagnose technical issues;
  • measure performance; and
  • improve our websites and Services.

The particular technologies we use may change as the Services evolve.

You may be able to control certain cookies through your browser or device settings. Disabling certain technologies may affect the functionality of the Services.

Where required by applicable law, we will provide additional choices or controls regarding non-essential cookies or similar technologies.

12. Sale, Sharing, and Targeted Advertising

Posma AI does not sell personal information for monetary consideration.

Certain U.S. privacy laws define terms such as “sale,” “sharing,” or “targeted advertising” more broadly than an ordinary exchange of information for money.

To the extent Posma AI engages in activities that constitute a sale, sharing, or targeted advertising under applicable law, we will provide any notices, opt-out mechanisms, or other rights required by that law.

If our advertising or analytics practices materially change, we may update this Privacy Policy and implement additional privacy controls as required.

13. Children's Privacy

The Services are intended for business and professional users and are not directed to children.

Posma AI is not intended for individuals under 18 years of age, and we do not knowingly seek to collect personal information directly from children through the Services.

If you believe a child has provided personal information to us, please contact support@posma.ai so that we can review the matter and take appropriate action.

14. International Processing

Posma AI is based in the United States.

Personal information may be processed or stored in the United States or other jurisdictions in which our service providers operate.

Privacy and data-protection laws in those jurisdictions may differ from those in your jurisdiction.

Where applicable law requires particular safeguards or mechanisms for international transfers of personal information, we will use appropriate measures as required.

The Services are currently designed primarily for U.S.-based real estate professionals. Availability of the Services in a particular jurisdiction does not necessarily mean that Posma AI actively markets or offers the Services in that jurisdiction.

15. Third-Party Links and Services

The Services may contain links to third-party websites, services, resources, social-media platforms, or other external properties.

Posma AI is not responsible for the independent privacy, security, or data-processing practices of third parties.

We encourage users to review the privacy policies and terms of third-party services before providing information to or interacting with them.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in:

- our Services;
- technology;
- service providers;
- data-processing practices;
- legal or regulatory requirements; or
- business operations.

When we update this Privacy Policy, we will revise the “Last Updated” date above.

If changes are material, we may provide additional notice where appropriate or required by applicable law, such as through the Services, by email, or by another reasonable method.

Your continued use of the Services after an updated Privacy Policy becomes effective is subject to the updated Policy, except where applicable law requires a different form of notice or consent.
