2. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Posma AI, Inc. or Posma AI platform (“Posma AI,” “Company,” “we,” “us,” or “our”).
Posma AI is a Delaware-incorporated C-Corporation providing AI-powered personal brand infrastructure for U.S.-based real estate professionals.
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you may not use the Services.
3. Description of Services
Posma AI provides software tools that enable real estate professionals to:
- Generate listing-based social media content
- Build a structured Brand Profile (positioning, voice, content pillars)
- Create weekly content strategies
- Generate email newsletters/market brief
- Create humanized content
- Draft replies to emails and direct messages
- Support consistent personal-brand and content development
The Services rely on third-party technologies and service providers to deliver their functionality. These may include artificial intelligence providers, payment processors, hosting and cloud infrastructure providers, authentication services, analytics providers, and other operational service providers. Such providers may change from time to time as we improve, maintain, and operate the Services.
4. Eligibility
You may use the Services only if:
- You are at least 18 years old
- You are a licensed real estate professional or authorized business representative
- You comply with all applicable U.S. real estate, advertising, and licensing laws
You are solely responsible for ensuring your use complies with your state’s real estate regulations.
5. Account Registration & Responsibilities
You agree to:
- Provide accurate and complete information
- Maintain confidentiality of login credentials
- Be responsible for all activity under your account
You may not:
- Share accounts across multiple unrelated users
- Impersonate another individual or brokerage
- Use the platform for unlawful or misleading purposes
6. Brand Profile & Content Responsibility
Brand Profile is an AI-assisted strategic foundation built from the user's inputs—not as autonomous competitor research or guaranteed differentiation.
Competitive and Market Inputs: Posma AI may use competitor descriptions, profile references, market observations and other information supplied by the user to develop directional positioning strategies. Unless expressly stated within the Service, Posma AI does not independently access, review, verify or continuously monitor third-party URLs, professional profiles, websites, social accounts, MLS records or market data. Users are responsible for the accuracy and completeness of information they provide. Users are also responsible for ensuring that any information they provide is lawful to share.
Competitive context: Posma AI analyses the competitor descriptions, examples and observations you provide. Profile links help identify the relevant professionals but are not independently reviewed unless the platform explicitly states otherwise. The resulting positioning is strategic and directional, not a verified market-wide competitive audit.
Posma AI allows you to create a Brand Profile, which directly influences all generated outputs.
You acknowledge that:
- Outputs are generated based on your inputs
- You are responsible for the accuracy of all information provided
- You are responsible for reviewing and approving all generated content before publishing
7. AI-Generated Content Disclaimer
7.1 No Guarantees
Posma AI does not guarantee:
- Increased listings
- Lead generation results
- Engagement or conversion performance
7.2 Human Review Required
You must review all AI-generated content for:
- Accuracy
- Compliance with real estate advertising laws
- Fair housing regulations
- MLS and brokerage rules
7.3 Regulatory Compliance
You agree that all content you publish will comply with:
- Federal Trade Commission (FTC) guidelines
- Fair Housing Act
- State-specific real estate advertising laws
- Brokerage compliance policies
7.4 AI-Generated Content Disclaimer - Additional
Brand positioning, competitive gaps, local market narratives and strategic recommendations are generated probabilistically from the information available to the Service. They represent possible strategic directions and are not guarantees that a position is exclusive, objectively superior or unavailable to another real estate professional.
8. Payments, Billing & Subscriptions
Payments are securely processed through authorized third-party payment processors, such as Stripe. Posma AI does not store your full payment card information. Additional financial service providers may be used as necessary to support the operation of the Services.
8.1 Subscription Terms
- Services may be offered on a subscription basis
- Billing occurs in advance on a recurring basis
8.2 Refund Policy
- Because Posma AI provides immediate access to personalized AI-generated content, strategic assets, and other digital services upon subscription, subscription payments are generally non-refundable. We encourage customers to take advantage of the 7-day free trial to evaluate whether Posma AI is the right fit before becoming a paid subscriber.
- You may cancel your subscription at any time. Cancellation will prevent future recurring charges but will not entitle you to a refund for the current billing period.
- Posma AI may, in its sole discretion, consider refund requests in exceptional circumstances, including certain billing errors or accidental renewals where the subscription has not been used after renewal. Any refund determination will be made on a case-by-case basis and shall not create any obligation or precedent for future refund requests.
- Unless otherwise required by applicable law:
- All subscription payments are non-refundable.
- No refunds are provided for partial subscription periods or partial use of the Services.
- Cancelling your subscription does not entitle you to a refund for the current billing period.
- If you believe you were charged in error or wish to request consideration of a refund under the exceptional circumstances described above, please contact us at support@posma.ai. We will review your request in accordance with this Refund Policy.
8.3 Failed Payments
We may:
- Suspend access
- Retry billing
- Terminate accounts after repeated failures
9. Acceptable Use Policy
You agree NOT to use Posma AI to:
- Generate misleading or deceptive property information
- Violate real estate advertising laws
- Infringe intellectual property rights
- Harass, spam, or mislead users
- Generate unlawful, discriminatory, or unethical content
10. Data & AI Processing
By using the Services, you acknowledge that:
- Your inputs may be processed by authorized third-party artificial intelligence providers, such as OpenAI, for the purpose of generating requested outputs.
- We use trusted third-party technologies and infrastructure to operate and deliver the Services.
- We take reasonable administrative, technical, and organizational measures to protect your information. For more details, please refer to our Privacy Policy.
11. Intellectual Property
11.1 Ownership of Platform
All rights in the platform, including:
- Software
- Branding
- Algorithms
- UI/UX
Remain the exclusive property of Posma AI.
11.2 User Content
You retain ownership of:
- Your inputs
- Your Brand Profile
- Your original data
11.3 Generated Content License
You are granted a broad, non-exclusive, commercial license to use generated content.
However:
- We do not guarantee uniqueness
- Similar outputs may be generated for other users
12. Third-Party Integrations
The platform may integrate with or rely on third-party services.
We are not responsible for:
- Downtime of third-party services
- Changes in their APIs
- Data practices outside our control
13. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in unlawful activity
- Fail to pay subscription fees
You may terminate your account at any time.
14. Disclaimers
14.1 “As-Is” Basis
The Services are provided “as is” and “as available.”
We disclaim all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
14.2 No Professional Advice
Posma AI does not provide:
- Legal advice
- Real estate compliance advice
- Financial or tax advice
15. Limitation of Liability
To the maximum extent permitted by law:
Posma AI shall not be liable for:
- Indirect or consequential damages
- Loss of business, revenue, or listings
- Errors in generated content
Our total liability shall not exceed the amount you paid in the past 12 months.
16. Indemnification
You agree to indemnify and hold harmless Posma AI from any claims arising from:
- Your use of the platform
- Violations of real estate laws or regulations
17. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
18. Dispute Resolution
18.1 Arbitration
Disputes shall be resolved through binding arbitration, except where prohibited by law.
18.2 No Class Actions
You agree to resolve disputes individually and waive class action rights.
19. Changes to Terms
We may update these Terms at any time.
Continued use of the Services constitutes acceptance of updated Terms.
