Terms of Service for Posma AI, Inc.

7.1 AI-Assisted Service

Posma AI uses artificial intelligence and automated systems to assist users with real estate marketing, personal branding, content development, communications and related activities.

AI-generated outputs are probabilistic and may contain errors, omissions, inaccuracies, unintended interpretations or other inappropriate or incomplete information. Outputs should not be treated as independently verified facts or professional advice.

7.2 Compliance-Oriented Safeguards

Posma AI incorporates compliance-oriented safeguards intended to reduce common risks associated with U.S. real estate marketing and professional communications.

Depending on the feature, content and information provided, these safeguards may evaluate or constrain outputs in areas including Fair Housing considerations; discriminatory, exclusionary or protected-class-related language; factual and geographic integrity; property and market claims; listing and MLS-related considerations; advertising and disclosure issues; professional-scope boundaries; fabricated experiences, credentials or claims; and other potentially misleading or inappropriate content.

Certain features may also provide publication checks or reminders identifying facts, permissions, attribution, disclosures or other matters that users should verify before publication.

These safeguards are risk-reduction mechanisms only. They do not constitute legal or regulatory review, certification, approval or a determination that any content is compliant.

7.3 No Guarantee of Compliance

Posma AI does not represent, warrant or guarantee that any generated output will be accurate, complete, current, lawful or compliant with every applicable federal, state or local law, regulation, Fair Housing requirement, MLS rule or policy, brokerage policy, licensing requirement, advertising standard, platform policy, Federal Trade Commission (FTC) guidelines, Fair Housing Act, State-specific real estate advertising laws, brokerage compliance policies, or other professional obligation.

Compliance requirements may vary by jurisdiction, brokerage, MLS, transaction, property, audience and factual circumstances and may change over time.

7.4 User Inputs and Free-Text Content

The quality, accuracy and appropriateness of generated outputs depend in part on information supplied by users.

Users are solely responsible for ensuring that information they submit to Posma AI — including Brand Profile information, property information, market information, listing details, personal experiences, credentials, free-text instructions and other content — is accurate, lawful and appropriate for the intended use.

Posma AI may use automated moderation and other safeguards to identify or restrict certain inappropriate or risky inputs and outputs. Such systems are not infallible and may fail to identify problematic content or may incorrectly flag acceptable content.

Users may not use instructions, free-text fields or other inputs to intentionally circumvent, override or defeat Posma AI's safeguards or to generate unlawful, discriminatory, deceptive or otherwise prohibited content.

7.5 Human Review Required

All AI-generated content requires human review before publication or other external use.
Users are solely responsible for reviewing, verifying and approving generated content, including, where relevant:

• Factual and property information;
• Market statistics and current-market claims;
• Fair Housing considerations;
• MLS and listing requirements;
• Advertising, attribution and disclosure requirements;
• Brokerage and licensing requirements;
• Permissions and intellectual property rights;
• Professional-scope considerations; and
• Any other requirement applicable to the user's jurisdiction, brokerage, MLS, profession or intended use.

The presence or absence of a warning, publication check, moderation result or other automated safeguard must not be interpreted as confirmation that content is accurate, lawful, complete or compliant.

7.6 User Modifications

Users may edit, rewrite, supplement or otherwise modify AI-generated content.

Any such modification is solely the user's responsibility and may alter, remove or circumvent safeguards reflected in the original output. Posma AI is not responsible for determining whether user-modified content remains appropriate or compliant.

7.7 Publication and Final Responsibility

Users retain final control over whether and how generated content is published, distributed, communicated or otherwise used.

The user is solely responsible for the final content and its use, regardless of whether it was generated entirely by Posma AI, generated partially by Posma AI, regenerated, shortened, edited by the user or combined with other material.

Nothing in the Services relieves users of their independent obligations under applicable laws, regulations, Fair Housing requirements, MLS rules and policies, brokerage policies, licensing requirements, advertising standards or other professional obligations.

7.8 No Professional Advice or Compliance Certification

Posma AI is a technology and content-assistance platform. It is not a law firm, regulatory authority, MLS, brokerage compliance department, tax advisor, financial advisor or other professional advisory service.

Compliance-oriented safeguards, publication checks, warnings and other features provided through the Services are intended to assist users in identifying potential considerations and do not constitute legal advice, professional advice, compliance certification or regulatory approval.

7.9 No Performance Guarantees

Posma AI does not guarantee increased listings, leads, engagement, conversions, revenue, market share, brand authority or other business results from use of the Services.

7.10 AI-Generated Content Disclaimer - Additional

A - Brand positioning, competitive gaps, local market narratives and strategic recommendations are generated probabilistically from the information available to the Service. They represent possible strategic directions and are not guarantees that a position is exclusive, objectively superior or unavailable to another real estate professional.

B - Regeneration of Content/Output: Regenerate with a new angle, not just new words. Posma is designed to meaningfully vary the approach while preserving your core facts, positioning, and relevant safeguards. When the topic or supplied information leaves limited room for variation, some regenerated outputs may naturally remain similar.

Payments are securely processed through authorized third-party payment processors, such as Stripe. Posma AI does not store your full payment card information. Additional financial service providers may be used as necessary to support the operation of the Services.

8.1 Subscription Terms

• Services may be offered on a subscription basis
• Billing occurs in advance on a recurring basis

8.2 Refund Policy

• Because Posma AI provides immediate access to personalized AI-generated content, strategic assets, and other digital services upon subscription, subscription payments are generally non-refundable. We encourage customers to take advantage of the 7-day free trial to evaluate whether Posma AI is the right fit before becoming a paid subscriber.

• You may cancel your subscription at any time. Cancellation will prevent future recurring charges but will not entitle you to a refund for the current billing period.

• Posma AI may, in its sole discretion, consider refund requests in exceptional circumstances, including certain billing errors or accidental renewals where the subscription has not been used after renewal. Any refund determination will be made on a case-by-case basis and shall not create any obligation or precedent for future refund requests.

• Unless otherwise required by applicable law:
  - All subscription payments are non-refundable.
  - No refunds are provided for partial subscription periods or partial use of the Services.
  - Cancelling your subscription does not entitle you to a refund for the current billing period.

• If you believe you were charged in error or wish to request consideration of a refund under the exceptional circumstances described above, please contact us at support@posma.ai. We will review your request in accordance with this Refund Policy.

8.3 Failed Payments

We may:

• Suspend access
• Retry billing
• Terminate accounts after repeated failures

• Generate misleading or deceptive property information
• Violate real estate advertising laws
• Infringe intellectual property rights
• Harass, spam, or mislead users
• Generate unlawful, discriminatory, or unethical content

11.1 Ownership of Platform

All rights in the platform, including:

• Software
• Branding
• Algorithms
• UI/UX

Remain the exclusive property of Posma AI.

11.2 User Content

You retain ownership of:

• Your inputs
• Your Brand Profile
• Your original data

11.3 Generated Content License

You are granted a broad, non-exclusive, commercial license to use generated content.

However:

• We do not guarantee uniqueness
• Similar outputs may be generated for other users

14.1 “As-Is” Basis

The Services are provided “as is” and “as available.”

We disclaim all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement

14.2 No Professional Advice

As described in Section 7, the Services may provide compliance-oriented safeguards, publication checks, warnings and other automated assistance. These features do not constitute legal, regulatory, brokerage, financial, tax or other professional advice and should not be relied upon as a substitute for qualified professional review where required.

Posma AI does not provide:

• Legal advice
• Real estate compliance advice
• Financial or tax advice
• Other professional advice

18.1 Arbitration

Disputes shall be resolved through binding arbitration, except where prohibited by law.

18.2 No Class Actions

You agree to resolve disputes individually and waive class action rights.
